These Terms and Conditions govern use of twelve2performance.com and the coaching services, sessions, programs, and materials offered by Twelve 2 Performance Coaching LLC ("Company," "we," "us," or "our"). Please review them before booking or purchasing. By affirmatively accepting these Terms when booking, purchasing, or enrolling, you agree to them. A signed coaching agreement or specific purchase terms will control over these Terms if they expressly address the same subject differently. Our Privacy Policy explains how we handle personal information.
Nature and scope of coaching
We provide educational and developmental performance coaching. Topics may include mindset; confidence; motivation and commitment; focus and awareness; self-control and discipline; process over outcome; mental imagery and meditation; routines and habits; and time management and organization. Topics may be offered as individual sessions or as part of a program, as described in the purchased offer.
Coaching supports personal reflection, skill development, goal setting, and practical action. It is not psychotherapy, mental-health counseling, medical care, diagnosis, or treatment, and does not create a therapist-patient or physician-patient relationship. Coaching is not a substitute for care from a qualified licensed professional. We do not provide emergency or crisis services. For an emergency, contact local emergency services.
Mental imagery, meditation, and related exercises are offered for educational and performance-development purposes. Participation is voluntary. You may decline or stop any exercise that causes discomfort. Do not use exercises requiring inward focus while driving, operating equipment, riding, or doing another activity requiring full attention. Follow advice from your qualified healthcare providers about any relevant health concerns.
Eligibility and services for minors:
You must be at least 18 and legally able to enter an agreement to purchase services. A parent or legal guardian must purchase and provide written authorization for any approved participant under 18. The adult purchaser is responsible for payment and required permissions. Before services begin, we will agree on appropriate communication, parent or guardian involvement, and confidentiality boundaries. These Terms do not replace a separate consent or participation agreement for a minor.
Your participation and responsibilities:
You agree to provide accurate booking information, attend prepared, communicate respectfully, and make your own decisions about applying coaching concepts. You remain responsible for your choices and actions. Results depend on many factors, including circumstances, participation, and practice. We do not guarantee a particular performance result, competition outcome, confidence level, scholarship, position, income, or other achievement.
Offers and payments
The applicable sales page, checkout, or written agreement identifies the service, session duration, delivery method, price, included materials, and any package limits. Unless otherwise stated, payment is due according to the terms presented during checkout or registration.
By submitting payment information, you represent that you are authorized to use the payment method provided.
Twelve 2 Performance Coaching LLC reserves the right to correct pricing errors, cancel transactions affected by obvious errors, or modify pricing for future services or offerings.
Scheduling, cancellations and refunds
Cancellation, rescheduling, and refund policies may vary depending on the type of service, clinic, event, program, or product purchased.
Any specific cancellation or refund policy displayed during registration, booking, checkout, or within a separate service agreement will control for that purchase.
When no separate policy is provided, fees already paid may be nonrefundable once substantial preparation, scheduling, digital delivery, or services have begun.
Twelve 2 Performance Coaching LLC reserves the right to reschedule or cancel coaching sessions, clinics, or events due to weather, horse or rider safety, facility conditions, illness, emergencies, or circumstances beyond reasonable control.
When Twelve 2 Performance Coaching LLC cancels a paid service and does not provide a reasonable rescheduling option, any applicable refund or credit will be communicated to the affected participant.
Privacy and recordings
We value your trust and aim to create a respectful environment where you feel comfortable sharing and learning. We treat personal information shared during coaching with care and discretion, consistent with our Privacy Policy and any signed agreement. Coaching does not establish legally privileged communications.
Group participants are expected to respect one another’s privacy and not share another participant’s personal stories or information outside the group without permission. While we encourage a considerate environment, we cannot guarantee what other participants may share.
Participants may not record, photograph, transcribe, or activate automated meeting assistants without our prior permission and any required consent from those involved.
Coaching materials and intellectual property
We or our licensors own our original website content, worksheets, exercises, recordings, and course materials. Your purchase gives you a limited, nonexclusive, nontransferable right to use included materials for your own personal learning, unless your written agreement expressly grants team or organizational use. You may not resell, publicly distribute, publish, sublicense, or use the materials to deliver your own paid program without written permission, except as permitted by law. You retain ownership of content you submit and give us only the permissions reasonably needed to provide the services.
Respectful conduct and termination
Harassment, threats, unlawful activity, unauthorized distribution of materials, and serious disruption are prohibited. We may pause or end participation for those reasons or when coaching is outside our scope. Where reasonable, we will explain the concern and offer an opportunity to resolve it. If we terminate a service, we will refund prepaid undelivered services, less only amounts properly due under the disclosed cancellation policy and applicable law.
Third party platforms and testimonials
We may use outside platforms for scheduling, payments, communications, and video sessions. Your use of them may also be subject to their terms. Testimonials describe individual experiences and do not promise that you will achieve the same results.
Disclaimers and limitations
We aim to provide useful, accurate educational content but do not promise that website content will be error-free or that website access will be uninterrupted. You should evaluate coaching suggestions in light of your circumstances and obtain qualified professional advice when needed.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from website use or coaching participation. Nothing in these Terms excludes liability for fraud, intentional misconduct, gross negligence, or any other liability or consumer remedy that cannot lawfully be limited.
Governing law and resolving concerns
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any dispute relating to these Terms or use of this website will be handled in an appropriate court having jurisdiction in Colorado, unless another dispute-resolution process is established in a separate written agreement between the parties.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Entire Agreement
These Terms, together with the Privacy Policy and any separate agreement applicable to a particular service, constitute the applicable agreement between you and Ashes 2 Wings regarding your use of this website and those services.
If a separate signed coaching agreement, clinic agreement, waiver, purchase agreement, or other contract contains terms that conflict with these general website Terms, the more specific agreement will control with respect to that service or transaction.
